Terms of Service
Last updated: April 2026
1. Scope and Provider
These Terms of Service ("Terms") govern the purchase and use of digital software licenses from:
Andreas Burget Arts Unique Spitzackerweg 13 79576 Weil am Rhein Germany Email: store@arts-unique.com
By placing an order through our store ("LicenseHub"), you ("Customer") agree to these Terms. If you are purchasing on behalf of a company or organization, you represent that you have the authority to bind that entity to these Terms.
If you are entering into these Terms as a consumer, mandatory consumer protection laws may apply and take precedence over certain provisions of these Terms.
If you are acting as a business, these Terms apply to the fullest extent permitted by law.
These Terms are provided in English. In case of discrepancies between translations, the English version shall prevail.
2. Definitions
- "Software" means any digital product offered through LicenseHub, including but not limited to Figma plugins, WordPress plugins, and desktop applications.
- "License" means the right to use the Software as described in these Terms and the applicable End User License Agreement.
- "License Key" means the unique alphanumeric code issued to you upon purchase that enables access to the Software.
- "Subscription" means a recurring license that renews automatically at the end of each billing period.
- "Billing Period" means the interval at which you are charged — monthly, quarterly (every 3 months), semi-annually (every 6 months), or annually (every 12 months).
- "One-Time Purchase" means a single, non-recurring payment for a perpetual license.
- "Consumer" means a natural person who is acting for purposes which are outside their trade, business, craft, or profession.
- "Business Customer" means a natural or legal person who is acting for purposes relating to their trade, business, craft, or profession.
3. Products and License Scope
3.1 What You Purchase
You purchase a non-exclusive, non-transferable license to use the specified Software. You do not purchase the Software itself — all intellectual property rights remain with Arts Unique. The scope of use is further defined in the End User License Agreement.
3.2 License Types
- Perpetual License (One-Time Purchase): Valid indefinitely from the date of purchase. Includes updates for the current major version. Future major versions may require a separate license or paid upgrade.
- Subscription License (Recurring): Valid only during the active subscription period. Includes all updates and major version upgrades released during the subscription. Access ends when the subscription expires or is canceled.
- Trial License: Valid for the specified trial period. Limited functionality may apply. One trial per person and product. Not available for commercial use unless explicitly stated.
3.3 Subscription Plans
Subscriptions are available in the following billing intervals:
- Monthly — billed every month
- Quarterly — billed every 3 months
- Semi-Annual — billed every 6 months
- Annual — billed every 12 months
The available plans and pricing for each product are displayed on the respective product page.
3.4 Activations
Each license permits a limited number of simultaneous activations as stated on the product page (typically 3). An "activation" means one installation or instance of the Software linked to your License Key. You may deactivate an existing activation at any time through your customer dashboard to free up a slot.
3.5 Permitted Use
You may:
- Use the Software for personal and commercial projects.
- Install the Software on multiple devices, up to the activation limit.
- Create derivative works (e.g., websites, designs, applications) using the output generated by the Software.
- Make reasonable backup copies of the Software for archival purposes.
3.6 Prohibited Use
You may not:
- Resell, sublicense, rent, lease, or redistribute the Software or License Key.
- Share your License Key with third parties or make it publicly available.
- Reverse engineer, decompile, disassemble, or modify the Software.
- Use the Software to create a product or service that directly competes with our products.
- Circumvent, disable, or interfere with the license validation system.
- Use the Software in any way that violates applicable law.
- Attempt to bypass licensing systems, share access credentials, or interfere with the proper functioning of the service.
4. Ordering and Contract Formation
4.1 Placing an Order
Product descriptions on our website constitute a non-binding invitation to make an offer. By clicking "Buy Now" and completing the Stripe checkout, you submit a binding offer to purchase the selected product at the displayed price.
4.2 Contract Formation
The contract is concluded when you complete the purchase process and receive a confirmation of your order. We confirm the purchase by delivering your License Key via the confirmation page and email. We reserve the right to decline orders at our discretion.
4.3 Order Confirmation
After a successful purchase, you will receive an email confirming your order, including your License Key, invoice, and instructions for activating the Software.
4.4 Delivery of Digital Products
Delivery of digital products is made electronically, typically immediately after successful payment. License Keys are displayed on the purchase confirmation page and sent to your email address. No physical goods are shipped.
4.5 Technical Requirements
It is your responsibility to ensure that your system meets the technical requirements for the Software. System requirements, if applicable, are listed on the product page. We are not obligated to issue refunds for incompatibility with your system.
5. Prices and Payment
5.1 Prices
All prices are displayed in Euros (€) and are final prices. All prices include applicable taxes where required by law. For customers outside the EU, taxes may be calculated based on the billing location.
VAT is not charged or shown separately pursuant to §19 UStG (German small business regulation).
We reserve the right to change prices at any time. Price changes do not affect existing orders or the current billing period of active subscriptions. For subscription price changes, see Section 6.6.
5.2 Payment Methods
Payment is processed securely via Stripe, Inc. We accept credit cards, debit cards, SEPA direct debit, Apple Pay, Google Pay, and other payment methods supported by Stripe in your region. We do not store your payment details — these are handled exclusively by Stripe.
5.3 Invoices
An invoice is generated automatically for each purchase and is available for download from your customer dashboard and via the link in your confirmation email. Invoices are provided in PDF format and comply with German tax law (§14 UStG).
5.4 Failed Payments
If a payment fails at the time of purchase, no order is created and no License Key is issued. You may retry the purchase at any time. For failed subscription renewal payments, see Section 6.5.
6. Subscriptions and Auto-Renewal
6.1 Automatic Renewal
All subscription licenses renew automatically at the end of each billing period. By completing your initial purchase, you expressly agree to recurring charges to your payment method at the then-current subscription price. Renewals continue indefinitely until you cancel.
6.2 Renewal Reminders
We will send you a renewal reminder email at least 14 days before each renewal date. This email will include the renewal date, the amount to be charged, and instructions on how to cancel.
6.3 Cancellation
You may cancel your subscription at any time using one of the following methods:
- Cancellation page: store.arts-unique.com/cancel-subscription — available without login, as required by German law (§312k BGB).
- Customer dashboard: Log in and click "Cancel Subscription" on your license detail page.
- By email: Send a cancellation request to store@arts-unique.com.
Upon cancellation:
- Your subscription remains active until the end of the current paid billing period.
- No further charges will be made.
- After the billing period ends, your license expires and the Software will be deactivated.
- You will receive a confirmation email with the cancellation date and the date your license expires.
The maximum notice period for cancellation is one month before the next renewal date.
6.4 No Pro-Rata Refunds
Cancellation does not entitle you to a refund for unused days within the current billing period, unless required by applicable law. Your access continues until the end of the period you have already paid for.
6.5 Failed Renewal Payments
If a recurring payment fails, we will notify you by email and retry the charge. If payment is not resolved within 14 days, your subscription will be suspended and your license will become inactive. You may reactivate your subscription by updating your payment method in your customer dashboard or via Stripe's billing portal.
6.6 Price Changes
If we change the subscription price, we will notify you by email at least 30 days before the new price takes effect. The new price will apply from your next renewal date after the notice period. If you do not agree with the new price, you may cancel your subscription before the renewal date at no cost.
6.7 Plan Changes
You may upgrade or downgrade your subscription plan at any time through your customer dashboard. When upgrading mid-cycle, you may be charged a prorated amount for the remainder of the current billing period. When downgrading, the new plan and pricing take effect at the start of the next billing period.
6.8 Reactivation
If your subscription has expired or been canceled, you may purchase a new subscription at the then-current price. Previous License Keys cannot be reactivated — a new key will be issued.
7. Right of Withdrawal
7.1 Statutory Right of Withdrawal
As a consumer in the European Union, you have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period begins on the date of contract conclusion (i.e., the date of your purchase).
Information about your right of withdrawal and its conditions can be found in our Cancellation & Withdrawal Policy.
7.2 Early Expiry for Digital Content
Since our products are digital content that is not supplied on a tangible medium, the right of withdrawal expires prematurely once we have begun delivery of the digital content (i.e., once the License Key has been delivered), provided that:
- You have given your express prior consent to the immediate delivery, and
- You have acknowledged that you lose your right of withdrawal upon delivery.
This consent is obtained during the checkout process via a mandatory checkbox.
7.3 Subscriptions and Withdrawal
For subscription licenses, the right of withdrawal applies to the initial purchase only. Subsequent automatic renewals are not subject to a new withdrawal period. To end a subscription, use the cancellation process described in Section 6.3.
7.4 Voluntary Refund Policy
Independently of your statutory withdrawal rights, we offer a voluntary 14-day money-back guarantee on initial purchases. If you are unsatisfied with the Software for any reason, contact us within 14 days of your purchase at store@arts-unique.com and we will issue a full refund. Upon refund, your license will be revoked and all activations will be deactivated.
This voluntary refund policy does not apply to subscription renewals.
8. Warranty
8.1 Statutory Warranty
We warrant that the Software will function substantially as described on the product page at the time of purchase. This warranty applies for a period of 24 months from the date of purchase (for one-time purchases) or for the duration of the active subscription (for subscription licenses), in accordance with applicable German and EU consumer protection law.
Consumers are entitled to statutory warranty rights. These rights are not limited by these Terms.
8.2 Bug Fixes
If a defect is reported during the warranty period, we will make reasonable efforts to provide a fix or workaround within a reasonable timeframe. If we are unable to remedy the defect, you may be entitled to a price reduction or, in cases of significant defects, a refund.
8.3 Exclusions
The warranty does not cover:
- Defects caused by modifications you have made to the Software.
- Incompatibility with third-party software, hardware, or operating systems not listed in the system requirements.
- Issues arising from use of the Software in violation of these Terms or the EULA.
- Features or functionality not described on the product page.
9. Liability
9.1 Unlimited Liability
Nothing in these Terms excludes or limits liability for:
- Death or personal injury caused by negligence.
- Fraud or fraudulent misrepresentation.
- Any other liability that cannot be excluded or limited under applicable law.
9.2 Limited Liability
For damages caused by slight negligence in the breach of a material contractual obligation (Kardinalpflicht), our liability is limited to the foreseeable, contract-typical damages. For one-time purchases, this is limited to the purchase price. For subscriptions, this is limited to the total subscription fees paid in the 12 months preceding the event giving rise to the claim.
9.3 Exclusion of Liability
We are not liable for damages caused by slight negligence in the breach of non-material contractual obligations. We are not liable for indirect, incidental, special, or consequential damages, including but not limited to loss of profits, data, business opportunity, or goodwill, to the extent permitted by applicable law.
9.4 Force Majeure
We are not liable for delays or failures resulting from circumstances beyond our reasonable control, including but not limited to server outages, internet disruptions, third-party service failures, natural disasters, pandemics, or government actions.
10. Account and Misuse
10.1 Account Responsibility
You are responsible for maintaining the confidentiality of your License Key and account credentials. You are responsible for all activities that occur under your account.
10.2 Prohibited Conduct
You agree not to misuse the platform, including attempts to bypass licensing systems, share access credentials, or interfere with the proper functioning of the service.
10.3 Suspension and Termination
We reserve the right to suspend or terminate access in case of violations of these Terms, provided that such measures are proportionate and, where appropriate, preceded by a warning. In cases of clear abuse or fraud, we may suspend access immediately without prior warning.
11. License Revocation
We reserve the right to revoke a license if:
- The License Key is shared with or used by unauthorized third parties.
- The Software is used in violation of these Terms or the EULA.
- Payment is charged back, disputed, or reversed fraudulently.
- You attempt to circumvent the license validation system.
Before revocation for reasons other than clear abuse or fraud, we will contact you and provide a reasonable opportunity to resolve the issue. In cases of revocation due to our error, you are entitled to a full refund.
12. Intellectual Property
12.1 Ownership
All intellectual property rights in the Software, including but not limited to code, designs, graphics, documentation, trademarks, and trade names, are and remain the exclusive property of Arts Unique.
12.2 Feedback
If you provide suggestions, ideas, or feedback regarding the Software, we may use this feedback without restriction or obligation to you.
12.3 Your Content
Any content you create using the Software (e.g., designs, websites, applications) remains your property. These Terms do not grant us any rights to your content.
13. Data Protection
We process your personal data in accordance with our Privacy Policy and the EU General Data Protection Regulation (GDPR). By using our services, you acknowledge that you have read and understood our Privacy Policy.
For subscription customers, we store your email address and payment method reference (via Stripe) for the purpose of processing recurring payments. You may update or remove your payment method at any time through your customer dashboard.
14. Communication
14.1 Transactional Emails
By making a purchase, you agree to receive transactional emails related to your order, including purchase confirmations, License Key delivery, renewal reminders, payment receipts, and cancellation confirmations.
14.2 Service Notifications
We may send you emails regarding important changes to the Software, these Terms, or our services. You cannot opt out of these communications as long as you hold an active license or subscription.
14.3 No Marketing
We do not send marketing emails, newsletters, or promotional communications unless you explicitly opt in.
15. Availability and Service Levels
15.1 License Validation API
We make reasonable efforts to keep our license validation API available at all times. However, we do not guarantee uninterrupted availability and are not liable for temporary outages.
15.2 Offline Functionality
Our Software is designed to cache the last successful license validation locally and continue to function for a limited period (typically 24–72 hours) without an active internet connection or during API downtime.
15.3 Discontinuation
If we decide to discontinue a product, we will notify existing customers at least 90 days in advance. Perpetual licenses remain valid for the last available version. Active subscription customers will not be charged for periods after discontinuation and will receive a pro-rata refund for any pre-paid period affected.
16. Third-Party Services
16.1 Stripe
Payment processing is provided by Stripe, Inc. Your use of Stripe's services is subject to Stripe's own terms and privacy policy. We are not responsible for Stripe's availability, performance, or actions.
16.2 Third-Party Components
The Software may include open-source or third-party components subject to their own license terms. A list of such components and their licenses is available upon request. Nothing in these Terms limits your rights under those licenses.
17. Applicable Law and Jurisdiction
17.1 Governing Law
These Terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
17.2 Consumer Protection
If you are a consumer residing within the European Union, you also benefit from the mandatory consumer protection provisions of your country of residence. Nothing in these Terms affects your statutory rights as a consumer.
17.3 Jurisdiction
For business customers, the place of jurisdiction for all disputes shall be the registered office of the Licensor (Lörrach, Germany), to the extent permitted by law.
If you are a consumer, you may also bring claims in the courts of your place of residence, as provided by applicable law.
18. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, or if modification is not possible, severed from these Terms. The remaining provisions shall continue in full force and effect.
19. Assignment
You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign these Terms without restriction, including in connection with a merger, acquisition, or sale of assets.
20. Waiver
Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision or the right to enforce it at a later time.
21. Entire Agreement
These Terms, together with the End User License Agreement, Privacy Policy, and Cancellation & Withdrawal Policy, constitute the entire agreement between you and Arts Unique regarding the use of our products and services. They supersede all prior agreements, understandings, and communications, whether written or oral.
22. Changes to These Terms
We may update these Terms from time to time. The current version is always available at this URL. Continued use of the service after changes have been communicated constitutes acceptance of the updated Terms.
For active subscription customers, we will notify you of material changes at least 30 days before they take effect. Changes apply to orders placed after the publication date.
